By The Gaze ("By The Gaze", "we", "us" or "our") is a Jaipur-based studio offering handcrafted, made-to-order accent furniture. Please read these Terms carefully before using the website or placing an order.

1. Acceptance of these Terms

By accessing this website, browsing our products, or placing an order, you confirm that you have read, understood and agree to be bound by these Terms and by our other policies referred to here (including our Privacy Policy, Shipping Policy and Refund/Cancellation Policy). If you do not agree with any part of these Terms, please do not use the website or place an order.

These Terms apply to all visitors, users and customers of the website.

By The Gaze sells handcrafted, made-to-order accent furniture such as ottomans, poufs, stools, pedestals, side tables and lounge chairs, and ships across India. The store is hosted on Shopify.

3. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract under Indian law to place an order with us. By placing an order, you confirm that you meet this requirement. If you are using the website on behalf of another person or a business, you confirm that you are authorised to do so.

4. Our products: handmade and made-to-order

Every piece is handcrafted and produced to order by our artisans in Jaipur. Because of the handmade nature of our work:

  • Slight variations in grain, finish, texture, colour, weave and dimensions are natural and are not defects. They are a hallmark of genuine handcraft and make each piece unique.
  • Natural materials such as wood, cane, leather and fabric may age, settle or change subtly over time.
  • Product images, swatches and videos on the website are indicative only. Actual colours may appear differently on different screens and under different lighting, and the piece you receive may differ slightly from the images shown.

By placing an order, you acknowledge and accept these natural characteristics of handmade, made-to-order furniture.

5. Pricing, currency and taxes

  • All prices are listed in Indian Rupees (INR).
  • Prices are inclusive or exclusive of Goods and Services Tax (GST) as indicated at checkout, and applicable GST will be charged in accordance with Indian law.
  • Shipping or handling charges, where applicable, are shown separately at checkout as described in our Shipping Policy.
  • Prices, offers and product availability may change at any time without prior notice. The price applicable to your order is the price displayed at the time your order is confirmed.

We make every effort to ensure that prices and product details are accurate. In the rare event of an obvious pricing or description error, we reserve the right to cancel the affected order and refund any amount already paid.

6. Orders and acceptance

When you place an order, you are making an offer to purchase the selected products subject to these Terms. An order confirmation acknowledges that we have received your order; it does not constitute acceptance.

A binding contract is formed only when we accept your order and begin production. We reserve the right to decline or cancel any order at our discretion, including where:

  • the product is unavailable or cannot be produced as ordered;
  • there has been an error in pricing or product information;
  • we are unable to verify your payment or delivery details; or
  • we suspect fraud or misuse.

If we cancel an order after payment, we will refund the amount paid for that order.

7. Payment

Payments on our website are processed securely through Razorpay, our third-party payment gateway. By The Gaze does not store, process or have access to your full card details; all payment data is handled directly by Razorpay in accordance with its own terms and security standards.

You agree to provide accurate, complete payment information and confirm that you are authorised to use the chosen payment method. Orders are produced and dispatched only after payment is successfully received, unless we agree otherwise in writing.

8. Made-to-order production timelines

As our pieces are made to order, they require time to craft. Estimated production and dispatch timelines are indicated on the relevant product page or shared with you after your order is confirmed.

Production timelines are estimates and may be affected by the complexity of the piece, material availability, artisan workload or other factors beyond our reasonable control. We will keep you informed of any significant delay. Made-to-order timelines are separate from delivery transit times, which are covered in our Shipping Policy.

9. Shipping and delivery

We ship across India. Delivery charges, transit times, dispatch handling and other shipping details are set out in our Shipping Policy, which forms part of these Terms. Please refer to that policy for full information.

10. Cancellations and refunds

Because our products are handcrafted and made to order, cancellation, return and refund eligibility is limited and is governed by our Refund/Cancellation Policy, which forms part of these Terms. Please refer to that policy before placing an order.

11. Intellectual property

All content on this website, including the By The Gaze name and logo, product designs, photographs, images, videos, illustrations, text, graphics, the "Journal" editorial content, and the overall look and feel, is owned by or licensed to By The Gaze and is protected by applicable intellectual property laws.

You may not copy, reproduce, republish, distribute, modify, sell or otherwise use any of our content for commercial purposes without our prior written permission. You are granted a limited, non-exclusive, non-transferable licence to access and use the website for your own personal, non-commercial use.

12. Acceptable use

You agree to use the website lawfully and not to:

  • use the website in any way that breaches any applicable law or regulation;
  • attempt to gain unauthorised access to the website, its servers or any connected systems;
